    Fraud under $5000
    Hi,

    I was arrested today and charged with fraud under $5000 and possession of a stolen credit card. Released on apromise to appear
    A few months ago me and a friend decided that it would be a great idea and acted on an impulsive decision and obtained a credit card, which was not ours. We went to HMV and purchased a dvd, and then syupidly pizza. The total of the stolen merchandise was $70 and we were both charged with the above offences.

    I was wondering what is going to happen to me, will I be convicted on a summary or indictable offence, will I go to jail, will I get probation?
    What are the chances of a conditional or absolute discharge?
    It is our first offence for both of us
    We both have no previous criminal record
    The total was $70
    We destroyed the card and ditched the merchandise immediately after we bought it as we felt terrible.

    2 don't make any confessions
    3. talk to an attorney before you agree that you did anything

    4. Get an attorney, a lot of things could happen, this actually will be two charges most likely, two separate events, each one a separate charge,
    You will have to pay the credit card company back ( and/or ) the store if they got charged back by the card company. There may be a fairly big civil penalty given, since there will be time and money spent by the loss control people of the credit card company and of the stores most likely)

    If they convict you or you plead guilty without a plea agreement, most likely you will get a large fine, pay civil award back, and probation.
    But if you get an attoreny you may get some settlement that may keep this off your record.
