Cosigning a lease agreement for apt?
My step mother co sogned an apt. lease for her grandson and his girlfriend. The grandson had colon cancer and couldn't work. He has since passed away. The girlfriend has stayed in the apt and has not paid rent for 2 months. She is facing eviction. My stepmother and the family has determined it is not our responsibility to support girlfriend now that grandson is deceased. Is there any possible way that my stepmother can be released from this liability. If not, it may be best to let girlfriend be evicted and take the hit to my stepmother's credit rating... please advise

    Hello O:

No. It looks like she doesn't have a choice.

My question here is who was on the lease? If ONLY the grandson was on the lease, with his death, her responsibility ends. However, if both the grandson and girlfriend signed the lease and she then co-signed, she is responsible for payment.

If the landlord sues your step mom, she will have to pay. So, what I would recommend is to inform the landlord that she will pay the rent to then end of the term. That she will NOT renew the lease and, at the end of the lease, she will no longer be responsible.

Then she sues the girlfriend for the rent she has to pay.
