Hi

One of my friend got 221 g Visa refusal for H1B.As the reason is petitioner is not able to give him an employment.So me too applied to the same company.Does it affect my case too?And is there any chance for him to take for H4 Visa?Will H1b refusal will stopped him to go for H4 Visa too.

H4 visas are for relatives of people on H1B, if his H1B was refused how is he also applying for H4? And if his was refused yours might be also. Perhaps the company has used their quota of visas available for the year, your friend should contact the company and see what exactly the problem was.

Thank you for your kind response.

My friend contacted the company.They said they will look into the case.I want to know once the Visa refused is there any chance for him to reopen the case since the reason is "the petitioner not able to give employment oppurtunity".And what was my second doubt is is there any problem for him to go to US as an H4 of his wife if his wife got H1B?

So Now my problem is my approval notice has been sent from USICS.Now this week or next week I need to go for Stamping to the same consulate where my friends H1B rejected for the same company.Is there any possibility for my case not to get rejected?

He can still enter on an H4 if his wife has H1B, remember the problem is the company, not him (if they gave the truthful reason why it was refused, and I don't see why USCIS would lie about this)

If the problem is that the company is not able or allowed to give your friend employment then most likely you will have the same problem. Just keep on top of the company and ask them what is going on.

Thank you for your prompt replies,Our company took this as a simple issue it seems.They said they are wondering about the response and they will cotact their Attorney regarding this.If they are able to convince the USICS that they are able to give employement.Mostly how long will it take to complete the process?

Is it possible for my friend to move to another consultant using the same receipt number?Will another company can process for him?

And the question which is out of my "221-g denial" is.My friend planned to go for Register Marriage as his would be in different caste.So if he applied for H4 will he needs to provide any special documents?Like Marriage Album like that?Can you please suggest how to proceed in that case.Anyways he is following up the company too by this time.
