We filed bnky in June 2008 & now we are three years in and we are having trouble paying our mortgage due to my job change again & my husband's overtime going away this month which is a $1400.00 difference. We are thinking about selling our house & using our equity to payoff the bnky debt. First of all can we do this? & also, what if our equity is not enough to pay off the bnky debt? Then what? I really need to know what I am doing on this. My atty off sucks so it is hard to get anything done. I am scared that we are going to be struggling for the next 2 to 3 years. What should I do?

Is this, I will assume a chapter 13 bankruptcy?

And of course the court will have to approve the sell of the home.
