Fraud Over 5000$
I was on ODSP [Ontario disability support program], and after 5 years, I decide to move out from ODSP, with my family and start working full time. 6 months after I left ODSP, same internal review officer from ODSP phone me and start asking me a lot of questions regarding my finance, about period January –Jun 2006, when I was already out of ODSP.
Before I left ODSP I was working little pat time and making same 200-300$ a month. First ODSP find over payment about 60,000$ for the period off 5 years. After I phone ODSP and
Said I’m going to fight decsion in court, the over payment went down below 30,000$.
In an end police charge me with fraud over 5000$. I find a criminal lower witch I pay over 3000$,
And after 15 months crown finely said no to my plead guilty deal, which was plead guilty for a half of 30.000$ for the period off 5 years. Now I don’t want plea a guilty on 30,000$ an also don’t want go to the trial, because lawyer ask me for 10.000$ and extra expenses? In 2-3 days I have to go see a canceler before trail. My lawyer said that he is done with me but he did actually noting. My question is what I can do in 2-3 days with canceler?

Hello un:
If it was me, I'd have a NEW lawyer there and ask him. I would NOT deal with people who are trying to put you in jail BY YOURSELF.

Yes, the other side can lie to you in attempts to make you sign s deal, happens every day.
But on the other hand if they have all the evidence they need to convict you, they don't have to deal,
So the more evidence they have, the lower deal you can get.

Ok, but I don't understand what canceller can or can't do now and what I can or can't do with canceller?

I'm not in Canada - what is a canceller?
Otherwise - have to agree. "They" are trying to put you in jail. Don't appear without an Attorney.

Hmm if I understand canceller is last step, before trail, last court appirence when I said [my lawyer] no deal with crown, judge said that I have to go [in 7 days], to see canceller and my lawyer and crown have to be there?
p.s. for about 15-20 months crown was quiet and finally judge said to crown, you have 7 days to answer a deal, and after 7 days crown said no deal?
p.s.2 …approx. 15 mounts a go, I told my lawyer that I will agree to plea guilty for about 7000$, he came back to me after approx. 20 days with good news that crown agrees on a deal…when I ask for more explanation, he said deal is pay back 30.000$, when I said that is not what we were agreed 20 days ago he start denying. I reminder my lawyer that he have that numbers in note in my file. I was right and I think he never mention that to crown?

This is so different from the US that I'm entirely lost - other than reminding myself once again to never get arrested in Canada!
