My X husband is 54,000 in arrears through the state of Kentucky in which I receive benefits (K-tap/welfare) for my children, he is also the same 54 thousand in arrears to the state of NJ who holds jurisdiction of the child support case, and will not release it because he is the father and still resides there. He is supposed to pay NJ, who in return pays Kentucky in lieu of the cash and medical benefits the children receive. Clearly he has not paid since he was placed on child support 8 years ago. Recently he was placed on disability and started receiving a check. He made an appointment for the children and found he could not collect benefits for them without having custody, so he sent me down to the Social Security office here in Kentucky to find that, because of his poor work history my children are entitled to three dollars a month. But they get a Retro active check from four years back totalling 130 dollars a piece. My X husband receives 720 dollars a month and his is also Retro active, his check is 20 thousand dollars. I immediately inform my case worker and the child suppert office. I also let my children know that they have an extra three dollars a month added to their spending money. Now that I have explained all the detail, my question here is... The case worker did not go after my x husband nor pursue the state of NJ like she has been for years while he had no job now that he is sitting on 20 thousand dollars, she wants my children's 3 dollars a month. Is that not like them paying their own child support and can she even do that?
