Should I call CPS?
My ex husband and I just went through a horrible two year custody battle. We finally came to agreement in mediation to have it split 50/50. I am okay to a degree with these arrangement except that when my son starts school I have to move down the street from him to continue the 50/50. I know my ex is doing drugs and selling pills but I can't prove it. I have been told by some very reliable people that he has told them himself that he has started doing drugs again. I have already gotten CPS involved once before because he burnt my sons face with his ciggarete while he was on pills but because he has a prescription from a quack they didn't do anything. My son comes to my house and his penis is filthy, like the never bathe him. I am very concerned for my sons wellbeing but I also don't want to seem like a vindictive ex cause that is just not the case. Any answers will be greatly appreciated. Thanks.

You should take your son to the doctor if you notice
ANYTHING untoward when he returns to you. Let the doctor report it if he feels there is abuse.

If you can prove the drug use, you report it, if you have or suspect abuse of the child, as noted take them to the ER and have it documented

I have taken him to the er that was why cps was called in the first place. The problem is I can not prove the drug use. I have friends that haven gotten high with him lately and have told me about it. Is that enough reason to call CPS?

Have you spoken to the Drug Task Force in your area to see if they are aware of him and his activity? Sometimes they don't act immediately upon suspicions but should he be pulled over in his car he may just have the car tossed to see if it contains anything illegal. They also may already be aware of him - you'd be surprised to know they DO know about a lot of people but they can't act upon the tips as they can't do drug raids wihout controlled buys (if he is a dealer).
If you feel your son is in physical danger, by all means report father to CPS. They have had their funding severely curtailed due to budget cuts and won't come out for just anything now, but will if it's something serious like the burn on the face.

I haven't thought of calling the drug task force but that's a good idea. Thank you.
