    Regarding FICA Exemption for Students
    Hello

I have been a student in the US since 2004. I have paid taxes for the calendar years 2004 through 2009. I was on an internship in Summer 2010, and was given a form 1099-MISC to indicate my earnings for that internship. I have continued as a student since then, and am due to graduate at the end of Spring 2011.

Being a full-time student at a university who has worked for 3 weeks under CPT during summer, am I liable to pay Social Security and Medicare taxes? Or am I exempt under FICA exemption?

    Thanks
    Srikanth

On F-1 you are exempt from residency for 5 years that is 2004 to 2008.
For 2009 and 2010, you will file resident tax return. You must pay FICA taxes.

FICA exemption [ 1 Answers ]

I was on F-1 from September 2001 to May 2006. I was then on OPT from May 2006 to Nov 2006. I read that you can claim a FICA exception for only 5 years. My university and my employer did not withhold FICA taxes for 2006. Do I need to inform them and get the FICA taxes withheld. Thank you, Thomas

Hi. I notice during the spring semester of 2006, FICA was being extracted out of my paycheck. At the time, I was a half-time, degree-seeking student at FSU. Is it possible to get this money back from my employer somehow because of the exemption rule? If so, how would I got about doing that?
