    Regarding FICA Exemption for Students
    Hello

    I have been a student in the US since 2004. I have paid taxes for the calendar years 2004 through 2009. I was on an internship in Summer 2010, and was given a form 1099-MISC to indicate my earnings for that internship. I have continued as a student since then, and am due to graduate at the end of Spring 2011.

    Being a full-time student at a university who has worked for 3 weeks under CPT during summer, am I liable to pay Social Security and Medicare taxes? Or am I exempt under FICA exemption?

    On F-1 you are exempt from residency for 5 years that is 2004 to 2008.
    For 2009 and 2010, you will file resident tax return. You must pay FICA taxes.
