    Wanting to visit my daughter who lives in another state
    "I live in indiana and my daughter lives in florida with her mother. she is 1. I am going down to see her but her mom refuses to let me see her. what are my rights when there has never been any court order"

    Are you the legal father? Generally without a court order you have no rights. If you are the legal father, it will be easier to get those rights. You will probably have to file in Fl for visitation rights.

    You have the right to file in court for court ordered visits.

    If you cause a problem at her house trying to see the child she can call the police and cause you trouble, which will go against you in court. If she says no, just don't see her till you get a court order.
    If she says no after a court order you take her to court

    Yes I am the legal father. My name is on the birth certificate as well. I just want to spend some time with her and she is being difficult.

    I would file in court but I live in Indiana and she lives in Florida. I am only going to be there for 1 week so how could I do that?

    Get an attorney with a relationship with a firm in her area.

    How long has the daughter been in Florida? If she has been here for at least 6 months, you would have to file in Florida.
