My sister has a 5 year old boy and a 2 year old girl and got divorced about a year ago because of physical and mental battery. Her husband would hit and rape her, said that if she ever left him he would kill her and their son. Her husband was in a federal prison and was raped, also a cousin in his family. He led her to believe that she had also been molested as a child. She would say its not true but that he must say it for a reason. Her husband and her would smoke marijuana and even when she was pregnant. She would leave the kids with anyone just to get her fix without even worring for the kids until the next day. She moved on her own with the kids after the divorce and has had several different guys sleep over .She moved several times because she would get evicted. She would not want anyone's help. She tried committing suicide earlier this year. After the incident she was checked-in to a psychiatric hospital to get help. She was diagnosed with post pardon deppression and was told that she needed to get treatment for a chemical imbalance. The doctor released her to us with the condition that she could not be alone or even alone with the kids. She was staying with our parents in a very comfortable apartment. We have tried to get her help but she is reluctant and insists she does not need any. She left with my aunt to another town in a 200 square foot apartment for a week to get away but after did not want to return. It has been 5 weeks now. Last night she left with some guy she has only known for 2 weeks and has taken the kids with her. To a town where she would go get marijuana with her ex-husband. We want to get her help,she does not want it. I am 31 years old and married with no kids, I am her older brother. Those kids are the world to me, I just want them to be safe and taken care of which she is not doing. I have several people that will testify with proof what I have said.I am very concerned about the safety of the kids and I feel I have no choice but to try and get custody of the kids. What are the chances of that happening?

The next time she messes up then take advantage of it. If you know for sure she is smoking dope then call the police. After her arrest make your move for custody. Since from behind bars she can't care for the children.
