Okay here is my problem and what I have against the mother as prove of her being an unfit parent. We have had my 2 year old niece now since she was 7 months old. At first it was on the weekends then it got more often till now she is with us permanent. She has been with us full time for over a year.I have permanent guardianship of her. She does not know her mom and dad. She has not seen them since Feb of this year. We have no clue where they are.I want to adopt her so there will never be a chance her mom can take her away from the only home she has ever known. I have a police report from Feb on her where she has a warrant for assault battery/ domestic abuse, I also have pictures of wholes in the walls of her home big enough for a grown person to climb through. There is drugs in the home. Before I got my niece she had never had her shots and most likely not been to the Dr or at least not like she should have. Mother has felonys on her record for drugs the police report from Feb Says suspected drugs. Her dad is not listed on birth certificate. She has lost her first 4 kids to Dhs. Has two kids in home we are working delengently to get out of there if only Dhs would do their jobs. We live in Oklahoma.

If the child has been in your care for a year then you can apply for adoption of the child and state your reasons before the courts. It sounds like it can get messy. Have you been receiving child support ? Is the mother collecting anything as benefit for the child and not passing it on ?

No no child support yes for about 6 months she did. I plan on it getting messy but I have been told by family members that they would tetsify but they had to be suppeoned because of the mom.

What does your lawyer say?

I wouldn't go into a consentual adoption without a lawyer--and yours is a mess. You really NEED to have a lawyer to go forward with this.

Have not got one yet got guardianship because I have no clue where she is.
