violation of probation 5 year joint suspension
HI everyone I'm new to this? So my boyfriend got arrested sep 4th for fighting in self defense their charging him with a assault deadly weapon, vandalism, and gang enhancement it doesn't look good he was already on probation due to a prior felony so they gave him a 5 year joint suspension so if he commits anything I am wondering if their going to give him the 5 years, his probation likes him but she said it was her job to take him in he has been clean in every test has a full time good paying job, so we bailed him out and he goes a week later to see his probation and she violated him for the prior felony charge of his past so now there is a probation hold on him, he has court tomorrow and we got an attorney he says he's going to try to get the probation hold off is that possible? Any is there any chances he won't get 5 years? I also got a letter from his boss saying good stuff about him will that help?

We get people here all the time wanting to know what's going to happen in court... Of course, we don't know... Most of the time, those decisions are based upon factors not presented, like the guys' prior criminal record, his age, and things like that...
You DID say he's got a job, a letter from his boss, and a good lawyer... Those are all good indications... However, they think he's a gangbanger, and that ain't good. Just listen to the attorney.

Thanks for your answer he had court today n he is facing 19 year, 10 years for the gang enhancment 5 years for the joint suspension and 4 for this new case :( this sucks he was doing so good he's 22 by the way.

Hopefully, they don't think he's too bad of a guy, and they'll let him plead to one count. Or maybe he should go away for a while. I don't know. Did he HURT somebody?

Not at all and I'm not just saying that cause I'm his girlfriend he was actually defending himself it was him and his buddy that he went to go visit and these guy started opening his mouth and saying stuff so he tries to pick a fight with my boyfriend I think this guy was drunk or something then like 6 guys more come out and get involve in the fight so my boyfriend and his buddy got jump and hurt these guys were fine, so the cops get there my boyfriend and his buddy ran so they look like the guilty ones cause they only got the other guys story so in the police report their blaming everything on my boyfriend :(sucks he was really doing good and he only ran cause he was on probation and didn't want to get caught but now is all in the hands of justice I just hope there not to unfair! What do you think about this?

But he has A 5 year joint suspension so he is going to prison for sure I'm just wondering for how long?

Possibly for the entire 5 years of the joint suspension.

The suspend sentence and the probation hold cause him a lot of problems. If the lawyer can get the new charges dismissed or lowered,he won't be look a such a huge penalty. Was this his 1st time violating probation, hopefully the lawyer is good and he can work some magic.

Hey how is it going? I'm on probation originally for residential burglary. I got put on a 4 year probation period with a 3-4 joint suspension. I had caught a d.u.I a year ago and violated my probation did some time and got out. I'm still on 4 years probation with the same 3-4 year joint.. I did a year and 2 months so far on probation and caught another violation for a dirty drug test for marijuana. This is my second violation. Do you think I will go to prison for it?

In July of 2007 my son was convicted of felony trespass to a vehicle and given 2 years probation.
In Janury of 2008 he got into a fight and was charged with battery, this put him in violation of probation. He went to county jail for 30 days and because he was locked up missed the battery court...
