    Welcome to AMHD. Your post involves at least two questions: 1) whether to file, and 2) when to file. The answer may depend upon how much of the principal is unpaid after the foreclosure and sale. If the lender is not going to pursue a 'deficiency' balance, you may not need to file. A third question is whether to file Chapter 7, or 13.
