    Charged with Mischief Under $5000 in Ontario, Can I Leave the Country?
    I am a 21 year old Ontario resident. My school has had a prank war with another University for many years. Long story short I was caught spray-painting part of a building, caught by the police and given a date for prints and a trial (Both in January).

    Question 1: I planned a trip for new years to Las Vegas, will leave the 31st be back on the 4th. Is it possible to leave Canada, and enter the united states and return or will my awaiting trial for a criminal charge prevent this?
    Note 1: The documentation I received after I was charged did not say anything about not leaving the country. The only condition was that I was banned from that University's campus until the trial date.

    Question 2: This is my first offense and I have no prior criminal record or any sort of criminal charges, and have never been charged for anything before. Does any one know if there is any chance I can get an Absolute Discharge or Criminal Discharge. I was told by the officer that many times people get charged the with the $ amount required to remove the spray paint, and if it is their first offense there is no criminal record.

    Yes, you should be able to leave the country.

    Officers are not lawyers and often lie to get you to confess or write a statement.
    I would get an attorney, better chance, since you don't want a criminal record.

    You should check your paperwork from the police. If you were given dates for prints and a court date, you should have also received release papers. There would be conditions on that paper that will let you know what you can and cannot do. For myself, I have been charged with Mischief under $5000 as well, and I cannot leave the province.
