Mischief under $5000, Theft Under, Break & Enter.
Hello,
My name is Tyler Batten, I am 18 years old and am a first time offender, from Kitchener, Ontario. Last weekend, myself and a friend were walking home from a party and
Found ourselves doing something very very Illegal. We stummbled into the waste management facility down by the river. Then, ended up taking a truck for a spin through the trail, in desperate hopes to get just a little bit closer to home. We stopped after about 5 minutes of driving and left the scene. The next morning I was awaken by a police officer who proceeded to read me my rights and handcuff me. I was just at the wrong place at the wrong time with the wrong state of mind. I am not known to be a malicious person and my intentions were not to go and steal a truck that night. I am currently in night school (upgrading my ENG4UI) and working full time. I will be starting Political science next septemeber at U of W. Is there any way possible I can come out of this without a criminal record? Please, please help me.

A really really good attorney
You have several crimes that are most likely added, tresspassing, theft
I really don't see any way out of this esp if you already confessed.

What about the Diversion Program in Ontario? Would that be a suitable program, I mean what would be the chances of me getting accepted into something like that? And if any one knows where abouts can I register... or ask for a crown to have me registered... :S

Again, you can try, while I understand the stupidity of youth and things done when drinking is involved.
Car theft sadly is not considered a prank. A lot also may depend on how hard the owners of the vechile are complaining. And if they have been paid back for any damages ( if there were any)
All you can do is try. The canada diversion programs are better than US ones many times Good luck

Hey Tyler,
My nephew did the same stunt as you last night and was charged with theft over 5000. He is 16 and was put in jail overnight before my brother was called this morning. He took a hydro truck, but never left their proprty - basically joyriding. I imagine that this can affect him for years to come, especially border crossing into the US.
Can you tell me how things have turned out for you so far?

Ok well What happened for me goes as follows: The Crown attorney made me an offer stating that 2500 dollars (5000/2) be paid back to the facility. I had a time frame to choose from. It was claimed that the write off value of the vehicle was 5000 when in fact it wasn't she is making me pay 5000 the most she possibly can, with no choice of community service. Cold hard cash. A criminal record was not issued, although obviously I was printed and photograped.

Thanks for coming back and bringing "us" up to date. Sounds a little hard nosed but I guess if the object was to teach you a lesson it worked.
I never understand the Canadian system anyway.

First of all, what did YOU tell the police? I'm not sure about Ontario's laws, but I'm sure they would have to prove a case.
From what I'm reading, they came to your house the morning after the incident. Only thing that this could mean is, one of the neighbors/ someone that lives nearby saw you as you walked toward your house.
Something I learned very quick in Atlanta, was to NEVER talk to the police. It can only hurt you. Not talking will not. Again I'm not sure about the laws up north, but I can't imagine them being too much different.
Anyway, so the question is:
What did you tell the police?
How many people were you with?
From the sounds of it, you walked home after leaving the scene. I don't imagine it being a very far walk?
What kind of neighborhood do you live in?
In these cases (down by the river, woodsy area? a few friends, late at night?) they probably have one lead that is not so strong. The rest is what you and your co-defendents tell them.. GL

Well this is the story, I was drunk this one night and me and my girlfriend and I got into this little fight, but then I ended up blacking out on people and damaging a house, and breaking a car window. I know psycho me. But no one seen me punch the car window. I got two counts of mischief under 5000.. what should I do ?
