17yrs old, mischief under $5000, Ontario
On April 5th my father called the police on me because I went outrageous when, after a week of not speaking, my father told me to sit down and talk, to only find out that things like my cellphone, my car (2 weeks old gift that I was grateful for), and my residence would no longer be available to me as I just got into a university. I was so frustrated that I tried to leave but my dad was blocking the doorway to get into the hallway, to leave in my mother's vehicle. I decided to go into the kitchen and rip out approximately five kitchen cabinets. Prior to that (id say about 3 days before), I ripped out 2 out of the 5 door and kicked a hole in the wall. I am truly sorry for my disturbance and my lack of problem solving skills but I do not believe that I am the only problem.

    1) I was to pay all the insurance (approxiamelty $5500) ( I agreed to pay 1/2)
    2) find a job (I am in 4th year high school trying to maintain my grades inorder to get into the post secondary school of my choice) (I also agreed and went around york region looking for jobs)
    3) have no access to a cellphone (I was not happy but I said fine. To this day the phone number is in use and my father is the operator of it)
    4) pay for my own residence (which I agreed to)

I feel that my father listens to me but at the same time does not give 2 hoots about what I want as a 17 year old... not a 12 or 13 year old.

    1) freedom to come home after 12 (which is not unreasonable since they claim that I can be trusted) (I do not drink or smoke and I am responsible behind the wheel)
    2) I should get a summer job and maintain proper grades for post secondary
    3) my father should not go to my girlfriend's house to embarress me and try to persuade her family that I am a bad person. (ive asked him to stop doing that and he agreed. But I found out that he did it 3 other times after the fact)

As of right now, I'm going to court on may the 7th for mischief under $5000. I have a restraining order and it is requesterd that I stay away from my parents and sister, and that I do not attend my residence. All has gone well and I have lived up to the limitations since April 5th. I went to mugshots and fingerprints yesturday. I have no lawyer and do not plan on getting any either. I was going to apply for an extra judicial sanction. I am currently attending anger management classes and I see a psychologist (which I have a letter from to maybe help with my case) and my guidance counselor who I meet with almost every day.

I just wanted to know what would happen on Wednesday for court. I'm a first time offender. The police officer charged me because my father did not want to. I am remorseful and want this to end. I am trying to do all that I can to fix myself before the court date to show responsibility.

Also, I would just like to know what kind of attitude an officer of peace is to give a 17year old who co-operated.

Thank you all for reading and responding.

Once your father involved the Police it was no longer his (your father's) to charge or not charge - it's now The People vs you.

I think as long as you are not taking full responsibility for your actions, are making excuses, you may have a problem in Court. Obviously your father had serious enough concerns that he was given a restraining order and you have to get around that obstacle, too. Ripping out doors, cabinets, punching holes are not going to go over well in Court.

Unfortunately, until you are full legal age your legal guardian (your father) gets to make the rules.

The best you can do now is follow the Court's directives and stay out of trouble.

No knowing what the Judge will decide - this is not a simple "under $5,000" criminal mischief case.

I don't think you understand. Im pretty sure I can get an extrajudicial sanction. Your from the US.. maybe you don't understand. Im not blaming my dad 100%. Im taking responsibilities for my actions. Im just adding what lead to the misbehaviour.

I knew all along that its me vs crown. That's not the issue here.

I would like to know what to expect in court and maybe a few questions that they will ask me so I can prepare myself with consice answers. I buckle up under pressure

I don't think anyone can tell you 100% except an Attorney - I gave it the best shot I could. This is not a routine "mischief" charge - you have other issues at play.

I would prepare myself via Attorney.
