    F1 student filing as resident-alien, questions on what forms to file
    Hi,

    I started my undergraduate study in USA from 1998 to 2002 as a F-1 student.
    I came back to the school to start the graduate school in December, 2006.

    For the year of 2007, I did not earn anything other than bank interests.
    However, school encourages me to still file the tax form even if earning is zero dollars.

    My questions are as follows,

    1) I am considered as Resident-Alien instead of Non-Resident Alien. So, I would like to know what forms I should file.

    2) I am married, but my wife is F-2 and does not have social security number. I can still file the tax return as joint or it has to be single ?

    3) Any issues to be careful about ? What if I don't file the tax form at all since I did not earn anything other than bank interests ?

    I am most curious about number one question and I am seeking help.

    1) You have NO LEGAL REQUIREMENT to file if your interest does not exceed $3,400. If you still want to file, file Form 1040EZ.

    2) If you file jointly, you need to submit Form W-7 with the return to get her an ITIN.

    3) See #1 above.
