Unwed father rights and responsibilities in California
My 25 yr old son's 21 yr old ex-girlfriend is 26 weeks pregnant. We know nothing at all about rights and responsibilities he will have if he is the father as none of our famiy or friends have had this happen. (She thinks he is the father, but slept with one other guy.) She is demanding $400/month child support or she will "turn him in to social services" who will come after him for all medical expenses. Then she says he will have to pay an additional $400/month when she puts child in daycare when she goes back to college. She says he is legally responsible for 50% of all expenses. He only makes $2000/month. How can he get reliable inexpensive information/legal help? BTW, she is surrounded by family and friends who ALL had children out of wedlock. (Her mom was 13 when she was born.) We are afraid she knows multiple ways to punish him... she threatens he cannot see the baby but that the state agencies will come after him for all costs like AFDC, WIC, Medi-Cal, etc.

When the child is born he needs to file for DNA and visitation. He needs to be proactive in this situation as soon as it starts.

This woman sounds like a real winner.

He needs to consult with a lawyer so when she makes all of these threats, he has an answer for her. I'm sure the lawyer will recommend a paternity test once the baby is born.

The mother is being silly. With what she is asking for.

There is no support paid at all, till child is born, He does not pay for birth of chid.

Once child is born, she can file for support, it will be based on his income. Normally no more than 25 to 30 percent of his income. If he has a job that furnishes insurance, he may be requierd to put the child on his insurance.

But he needs a good attorney, not just a cheap one
