    I want custody of my 8 year old sister I'm 18
    I am leaving for Army bootcamp this upcoming 9th of July. My parents aren't divorced but looks like they will soon. Well my story is long but my mom hasn't never been employed she doesn't have a h.s diploma & 2 years ago she tried committing suicide. My dad is a great man self employed all his life he's always been there for his kids but he feels he's not the one to have custody since my sister needs a mother figure more than father according to him. I want to file for her custody as soon as I get stationed. What are my chances of actually getting her custody. Since I am still very young?

    And since even your father seems to disagree with your idea of who your sister needs most.

    And other reasons too, I expect.

    Parents are preferred over other relatives when it comes to deciding custody.

    Probably very slim - unfortunately. When you finish bootcamp how long will you be stationed in one place?

    (Wish there were more people like you.)

    In order to get custody you have to provide for your own place to live, be self supporting, be stable. It sounds like you are.

    On another point - thank you for defending the rest of us. Enlisting right now must be a difficult decision.

    Would your parents consent to your sister living with you?

    More importantly, it sounds like it might be the best decision for your sister. If your parents are willing to give you guardianship, that would be the way to go. The fact that you will be Active Military is going to be in your favor. You would have to be in a stable place - no taking custody and then being sent overseas.

    If your father can get custody he can then give you guardianship although no one can say 100% without know what State (and you don't need to post that now) so you can get medical care for her, enroll her in school.

    I try not to get involved oin the personal issues on the boards. For whatever reason your thread has really touched me - I truly don't know why. Maybe because it's a sister, concerned about a sister? I don't know - and emotion has no part on the law boards. I'm the first person to say so.

    Go to basic, get stationed, see if you can get legal guardianship.

    I will bet you are your sister's role model. Good for both of you!
