    Attempt theft 5.24 c.c. and mischief under 5000 5.430(4) c.c.
    My name is David Baker I am 23and have recently moved to sudbury ont to attend cambrian college.

    I recently started too take champix with great success in quitting smoking. I went too a party with one of my room mates and we partied well into the night. As the night came too an end my room mate went home and I was left at the party.after I left I found myself lost and basically black out drunk I mustve gotten too cold in the fall weather because I took refuge in a mans truck that was unlocked. I was told that I broke his cd player and broke his center console. ( all of which I don't remember doing and is entirely out of character.)
    I was picked up by the police and was later charged with:

    Attempt theft 5.24 c.c. and mischief under 5000 5.430(4) c.c.
    I am scared too death right now and am not eligeable for legal aid and can't afford a lawyer.

    What should I do?
    p.s. I have also bin told by all of my friends and many other people as well as a pharmisist too look for changes in my behavior due too the champix pills, I have also learned that the pills have been banned in the u.s. for causing people to do and think things that are very similar too what I have done, and my room mates have said that there have been some changes in my behavior prior to the incidence does this affect my case?

    You need an Attorney.

    You can try to fight this yourself but I predict you will not be successful.

    I find very limited information on Champix and alcohol - a lot of opinions and "funded" studies but nothing that definitively answers whether it is safe. I have also checked through Pharm Bulletins which I receive and have found nothing definitive. You might wish to try this argument but without proof I doubt you will be successful.

    Did you obtain it by prescription or over the counter?

    Aside from the champix what am I up against? And should I seek legal aidor duty council?

    There's no injury not to mention that by the OP's admission, he was "black-out drunk." No injury lawyer in their right mind would even touch such a foolish notion of a "case."

    First I am sorry for poor to totally bad advice, this is a open forum and sadly some people even after being warned seem not to know when not to post here. For that they may soon be banned if they continue.

    First you have no law suit against anyone since they do put warnings on the pills.

    Next you can use the pills as a defense only if their side effect is medically known and accepted.

    The issue here is to try and work out a plea agreement.
