    Trepass court date coming up
    I have a trepass summons (140.05) it is a first time offense. Im extremely curious/confused/nervous as to what will happen, i hear this kind of charge is frequently drop; when i appear at court how can i go about to have the charge dropped?

    Its impossible for us to know what a judge will do, especially without knowing the circumstances around the charge.

    thank you for responding and trying to help but i would just like to know what typically happens when you go to court... i.e. (if any) what kind of paper work gets filled out, the ticket/summons also says i must declare either guilty or not guilty...and scott this all ocured at a shopping mall my sister tried to take an item, i took the fall the cops were "nice"[i think] and only gave me a trespass summons which as i've come to find out is only a violation and many times the charge is dropped.
    im also afraid that if i explain the situation to the judge it will only get me(or my sis) in deeper trouble what should i do?

    Is this your first appearance? In my area you go to Court, speak with the Assistant DA, he/she explains the charges and asks you guilty or not guilty, explains the possible ramifications, you go before a Judge. The Judge "usually" adjourns it to another date to give you an opportunity to hire an attorney.

    I've seen the ADA drop the charges and have no second hearing scheduled.

    Whatever is going to happen happens at the second hearing.
