    Rental in foreclosure?
    Hi everybody,

    I'm a single Mom and I rent a townhome and am up-to-date on my rent payments.
    A came by wanting to do a home inspection and claiming my rental is in foreclosure. How can I find out if my landlord has my home facing foreclosure?

    Ask your landlord, he/she should tell you if there is a problem.

    Not necessarily so.

    I've seen many landlords hide this fact from their tenants. Think about it, if he can keep collecting the rent, and not pay the payment, why would he tell you that?

    I have seen people stop paying the landlord, but put the full rent in a savings account. Then, explain to the landlord that once this "foreclosure" mess is figured out, we will hand you the full rent due at that time. This is how you will get him or her to explain what is going on, and what they expect to happen.

    Several issues, if the lender sent someone for a home inspection, then the loan is behind, sending someone is the first step, but the foreclosure can take months and the landlord may or court catch up any payments so this does not mean the house will foreclose.

    Now of course you can not legally stop payment, what he does with your rent money is not a legal issue ( maybe should be but it is not)
    If you stop paying, they can and will just evict you for not paying, the landlord being behind in his payments is not even a defense.

    Next the landlord has no duty or responsiblty to tell you anything, Now you can ask them, but they have no duty to tell you.

    May not sound fair but in these cases, you can be held to your rental agreemen for as long as the landlord is still the legal owner.
