    TAA lease incorrect and major problems w/apt
    I have been living in an apartment that has had some major sewage back up, causing living conditions to be well... unlivable, plus we have air conditioners that don't work correctly,cold water I kitchen doesn't work, none of the toliets work, this is just the big stuff.
    When we got a notice on our door to renew our lease I knew it wasn't time, so I looked at my lease a found that under rent amount it stated $70.00 instead of $700.00, I immediately called my best girlfriend who is an apartment manger and asked her about this, she stated that it is a legal and bonding document and would up hold in court.
    We have called code and compliance and the manager sent her maintenance crew to come and fix the toliets, but that is the only thing they fixed, we also only gave them a money order for $70.00 this month per lease agreement.
    Iam just wondering if Iam in the right or if I will have some legal problems with this situation? Can you help me out?

    I doubt if a court would uphold a typo like that, but its certain worth a try. However, if you had been paying $700, that would make it even harder.

    I'd have to agree there, get a lawyer right away, they can help you hold your rent money in an escrow account until all the repairs are done, I think they will advise you to put 700 a month in the account, if you always paid 700 then you were agreeing that was the correct rent.

    It has been one week since we paid the $70.00, and we haven't heard anything from the manager, I have multiple people in the apartment that I have talked to that are calling the code and compliance to report a lot of the same problems that I have been having.
    The apartment went under new management a month ago, and she is being very rude and not understanding with all of this, could I just find another place to live and break my lease, with all of these unhealthy living situations with a 19 month ols son and I am 7 months pregnant, Iam in fear of our health.
    I just hate the fact that I feel like the bad guy is winning and all these other people that live here that are afraid to say anything because they are not in the best financial status, plus I won't be able to move right away I have to make the money first and find somewhere to move close to here being that my parents live here and are my night time babysitters when I work.
    This is so frusterating, and I feel like Im fighting a losing battle

    You can't just declare the premises unlivable and break your lease. You have to have the housing people come in and issue code violations and give the landlord time to fix them. If they are reported and not fixed, then you can give notice.

    The housing people came in and wrote the apartment citations. The came in and fixed the toliets and that's it, there are multiple other problems that have not yet been fixed, so I guess I need to call the same guy out to get them to write them actual tickets, the thing about it is , that the gentlemen that came from the housing said that these apartments would rather pay the ticket than to fix the problem and people are able to break there lease and they are just making the money off the rents that have been paid.
    There has got to be something that can be done against these people for letting people live like this.
