    Deed title change
    In anticipation of marriage my niece bought a house and put her fiance's name on the deed. The wedding is off and she needs to get his name off the deed. He had nothing to do with the mortgage. His name is on the deed only and solely in anticipation of the marriage. Looking for deed correction without transfer tax implications.

    This may get dirty. I think he has to agree to having his name taken of it. In that case it will be a quit claim deed that is if he agrees.. if not time to see a lawyer... that would be wise anyway, also she may have to contact the people she has the loan through. We are going through a similar problem. :0 good luck

    There needs to be a deed prepared. The deed must be from your niece and her ex, as sellers, to your niece as buyer. Then the deed must be recorded in the county clerk or county register's office.

    I suggest that she has this done by a real estate attorney or title agency to make sure that it is done properly.
