    How do I evict my boyfriend?
    I live in Texas. My boyfriend has lived with me for 12 years. He moved into my house on my property. The land and house are in my name only as I had possession of it before he was in the picture. I pay ALL the bills and they are all in my name. He pays nothing. He holds a job on and off and does stuff around the house but has no financial responisbility. We have no joint accounts for anything. We do not present ourselves as a married couple so common law is not an issue. He is an alcoholic. He states he is going to AA but I have doubts. He is running me into the ground financially, emotionally, and physically. There is no lease or rent agreement.

    The issue is I want him to leave and I tell him repeatedly; almost daily, but he refuses. He has no place to go. I have offered to get a loan to move him out to help him get on his feet. I have told him he can take anything he wants in the house EXCEPT stuff given to me by my family (he can take TV, bed, dresser, dvds, etc). He drives a truck I pay for. He can take it too. He will not leave. He states he loves me and he will try to change. I wish him no ill will and want him to get better and be successful but I need him to leave. He has a temper which has led to many holes in walls and door, and many broken phones and remotes. (none of which he fixes or replaces). He has issues that go back to his parents divorce and just an all around ty family.

    What are my rights? What can I do to get him to leave? What are his rights? I have told him repeatedly that I will go to a lawyer and get him out through eviction. I have yet to act but am getting tired of being miserable in my own home. I do not want it to get ugly but...

    PLEASE ADVISE...

    He is a tenant. You give him written notice to vacate within 30 days. If he fails to move out, then you go to your local housing court for an eviction order. If he still doesn't move, you hire a sheriff to physically remove him.

    After cohabitating for 12 years... you really need to look into the possibility he has a legitimate claim to "common law marriage" I know that's 7 years in the state I reside. And no... you don't need a ceremony to occur for it to happen. That could complicate an otherwise simple eviction.
