    How do I evict my boyfriend?
    My boyfriend and I have been together off and on for 10 years. A lot of that time he did not pay anything for living in my home. He now gives me $100.00 a week. For that amount He eat, sleeps, has phone, cable, and vehicle to drive as needed. I no longer want to support him. I gave him a verbal 30 day notice to vacate my home. Now as we are getting closer to the time for him to leave, he tells me I will have to legallly evict him. What can I do to get him out of my house by the end of July. July 31st was the date he agreed verbally to be out. Now he is making my life and my 15yr. Old son uncomfortable. He is not physically violent but he does drink everyday.

    Yes you have to legally evict him
    First you have to give him a written notice. Whether it is 3 days or 30 days or whatever depends on what state you live in.
    Then if he does not leave when the time is up you have to go get a formal eviction notice from the court. Then if he still doesn't leave after the time is up the sheriff/constable will make him leave

    Nohelp is correct. You would have to legally evict him.

    Unfortunately, the 30 day verbal notice you gave him probably won't "count" as your official notice. If it came up in court would he admit that he agreed to that notice?

    Because you have no written lease (I assume?), he's a month-to-month tenant. Look for the link to your state's landlord/tenant laws in the "sticky" at the top of this forum. If will explain the length of WRITTEN notice you must give him. Once that has come and gone you'll give him a holdover notice. Usually around 3 days, can vary by state. Then if he still doesn't leave you go file an eviction suit. Usually at the JP or magistrate for the precinct where the house is located.

    Make sure you do everything in writing. State, "at this time I wish to end your month-to-month tenancy at _______address_______. You must vacate the dwelling and return your keys by midnight of _______date____."

    Once you give him the notice I'd steer as clear of him as possible. (I know, probably not easy.) Where will he go? I'm asking because I'm wondering if you could buy him out by paying for his security deposit at a new place, or something.
