    Theft under 5000 first offense/minor
    So first off I live in Quebec,Canada.2 days ago two friends and I were arrested for theft under 5000. It's a first offense for all of us. When they brought us to the police station we all stayed silent. Now my friend wants to press charges on the security guard from the store because he used a lot of force on her when it wasn't necessary and now she has 3 broken fingers. Where the security guard beat her up there were multiple cameras so should she press charges against him or will it make it worst for our case? Honestly I just want the charges to be dropped. I'm also scared because I know it takes a long time to go to court and I might be 18 by the time of the court date,what happens then? I spoke to lawyer on the phone at the police office and she said the prosecuter most likely won't even bring it to court,do you think that's true? What do I do in general? Oh by the way nothing was found in my bag.

    OK well the prosecutor may still bring it to court it depends on who saw the crime go down I'm a security guard myself so if the security guard seen the crime or shoplifting (im just assuming it was shoplifting) but it depends on who saw it go down cause if the store manager or an employee saw it they can tell the security to arrest you on there behave but the store manager or employee would have to show up in court for that situation had chances are they will not want to go or press charges but if it's the security guard that saw you then it's a higher likelyness he will go to court because its part of his job. My suggestion to you is to get your own lawyer and with the charge you will be charged with the crime at the age you convicted the crime. And as for your friend if she was resisting arrest from the guard then I recommend her not to go through with the pressing of the charges when your in security and you have to take some one down we have to fill out a use of force paper saying if it was the right amount and stuff so they will bring that out in court and the security guard will also have to fill out notes of the take down in his note book and on a special piece of paper for the security company so if he brings that note book into court and its valid and written in properly (and I'm pretty sure it would be cause its our job just to take down notes even though nothings really going on) that note book is like gold to the prosecutor so hope this helps you a bit oh and if you end up going to court your best bet if they have evidence on you like video footage is to get your lawyer to get you an absolute discharge but again your under age so you should be fine
