Involuntary Termination of Parental Rights
When my husband took his ex to court he was granted temporary primary custody. During this time she called during the regular court appointed hours but we think it was because WE were ordered by our lawyer to keep a call log. A few months later he was granted full primary custody she was court ordered to pay child support ( starting Jan 2011 ) and give us all documents ( Birth certs, SS Cards ) to enroll them in school. She never did and so I went online to get all the documents they needed. At this time WE were having the kids call her every week, again our lawyer told us NOT to hunt her down and when we stopped having the kids call her, she finally started calling them. Eventually she got a job ( after she was months behind in child support ) but we gave her the benefit of the doubt. After her being 9 months behind we called the proper place to get her wages garnished, we found out she had given up custody to her older child due to the fact she was pregnant and the child advocate told her it would not look good on her behalf to show herself in front of the same judge as we had while the bio-mother was knocked up. Needless to say after a few months she lost her job so we lost the support we were getting for the children in our care, plus she had moved and not given us her new address nor would she when we asked her, even IF the court papers requested we did. When we moved we informed her, gave our new numbers, address and emails. Soon her calls to the children became less frequent, 1 a week, 1 every 2 weeks, 1 a month, 1 every 2/3 months and now the kids are lucky to hear from her on their birthdays and major holidays. We got tired of hunting her down and fighting with her to be mother to her children. We heard she moved into a trailer park where known sex offenders are but still we gave her the benefit of the doubt and told her what 3 weeks out of the year she was to have the kids ( its was our year to choose ) but she never answered her back. In fact we are going on 2 months of not hearing from her and weeks now passed the date she was suppose to take them. The kids cried for days about having to go with her because she often left them alone, or with friends for days at a time when they were in her custody. My step son freaked because he didn't want to get eaten by fleas, which sadly both children and their clothing were infested with when they came to live with us. Although we are friends with her oldest child's father he proceeded to tell us she got a job working 1 day a week for 4 hours ( under the table ) in a very low class club. Since then we seen several post on her FaceBook page about her buying a car, getting tattoos and piercings and going out with this guy and that guy but she NEVER makes time to call her children ( any of them ). Since she basically abandoned them and no longer supports them, can we involuntary terminate her parental rights?
