    Termination of Parental Rights
    My ex-husband was just awarded sole custody of my daughter with me being awarded visitation that must be supervised. I have had permanent managing conservatorship of my daughter since our divorce about 6 years ago. CPS got involved about a year ago because my daughter had made some allegations about my fiancé. Allegations of sexual abuse. Ok, I know this may sound bad, but the allegations were not that serious. I truly believe nothing really happened because my daughter said it happened when the three of us were sitting on the couch together, and I was in the middle of them. She says she didn't like my fiancé but she only wanted me all to herself because it's just been the two of us for so long.

    The Grand Jury decided not to indict my fiancé and were not pressing any charges against him. My daughter has told her counselor, CPS caseworker, and the attorney ad litem that she wants to live with her dad.

    From the beginning CPS made it sound like we would all be able to do some kind of family and individual counseling and that the three of us would be able to live together again. Then all of a sudden they tell me that I would not get custody back if I stayed with my fiancé and that I had to get rid of him and never have anything to do with him ever again.

    Then when the court process began, at about the second court date, when CPS and the attorney ad litem knew I still had contact with him and was still seeing him, CPS wanted to give custody to the father and allow me to have visitation as long as my fiancé was not around and didn't have any contact with my daughter.

    Well, like I said, the final order is in place now, and my ex-husband ended up with custody anyway and now I have to have supervised visits. If I were to go back home and be with my fiancé, can my parental rights be terminated just because I'm with him? He hasn't been charged with anything, hasn't been arrested, was not convicted and does not have to register as a sex offender. I plan on continuing to see my daughter as much as I'm allowed and talk to her as much as possible and I am paying child support.

    I just want to know if my parental rights can be terminated. My mom is worried that they will be and that all my ex-husband has to do is call the judge and they'll haul me back into court. I tired to tell her that you can't just do that, but she doesn't believe me.

    Getting parental rights terminated is not easy to do. So I doubt if that will happen, unless you bring your fiancée in contact with your daughter. Given what the court did, any slip up there could result in reduced visitation or worse.

    Right, and I understand that. The final order did state that he was not allowed to have any contact with my daughter and I wouldn't do that anyway, I'm not that stupid. I plan on keeping as close of a relationship with her as I can.
