    How to get an ex-girlfriend to move out
    My girlfriend and I broke up and now she won't move out. Her name is not on the lease.

    You have allowed her to become a resident so she now has rights. Check the eviction procedure in your state because you will need to follow those steps and evict her, lease or not.

    You evict her... give her written notice to leave that her rental agreement isn't being extended (technically she is subletting from you and you in this case are her landlord), depending on where you live that's usually 30 days. Then if she doesn't leave file for eviction.

    As was mentioned above... there are specific requirements that HAVE to be followed to the letter.

    And THAT can get you into great legal trouble if they decide to make a point... no court would back you up if they took it in front of a judge.

    Welearn, this is a law question and answers need to follow the law. Your advice would get the poster in very hot water. This action would be illegal and he could get sued for damages.

    It matters not if you own the home. If you have someone who is living in the home that person is a resident. They must be evicted if they won't go on their own. Locking them out is illegal. If you think I am wrong just ask an attorney or call your police department and ask them.

    I'll back that up. I know a guy (the homeowner) who was renting a room to someone who was dealing drugs... before the dust settled my friend the homeowner had to move out under court order before the drug dealer got legally evicted. Because he tried to do exactly that.
