Co-Signer for apartment... Do they have rights to enter whenever?
If I had to have a cosigner for my apartment, does the complex have the right to release a key to the signer? Or is the signer just responsible for the rent if its not paid?

    Hello s:

It really depends on what the lease says... If he's listed as a roommate or a co-tenant near the TOP of the lease, he's entitled to key...

But, SOME leases have places for co-signers to sign at the BOTTOM of the lease indicating that they're responsible for the rent only...

I would write a letter to the landlord asking them to change locks because you don't want your cosigner to have a key.. That shouldn't bother them. YOU are their customer and YOU'RE the one they should have to satisfy.

A co signer is a person who merely agrees to pay the lease payments and damages if the person on the lease does not pay, They are not a co-leaser and have no right to enter the apartment.

If they are named on the lease as one of the people leasing or renting, then they have access. But a co signer is merely notified after there is a default as to how much money they owe.
