I was arrested for fraud under because I gave a check to a tow truck driver from my wrong account and the one I gave him was closed what do I do

Didn't they contact you to tell you it bounced and give you a chance to pay in cash before you were charged? Everyone who bounces a check doesn't go straight to being charged and arrested. Usually that's a last resort when they blow off being told to make good on the debt or else. Was there more to this then you have said?

Yes there was an argument about taking the check in the first place and it never bounced the account was closed I gave him the wrong one from the wrong book he said in the police report that he tried to contact me by going to the address on my license when knowing that I lived at the address where he provided the boost service

You have two possibilities... the check either gets cashed... or it bounces... in this case it bounced (bounced in it wasn't paid for ANY reason) and that person gets hit with a bounced check fee that makes it even worse for them.

What do you mean about the argument about taking the check? I think that holds the key to WHY you were prosecuted. You are aware you are required to go to the DMV and having your license changed whenever you move. The fact you didn't also is evidence to commit fraud. And with a bad address on the ID , writing a check against a closed account... add in an argument those are the reasons they had you charged. I would have done the same given the circumstances from their perspective. I've been stiffed before so the good will well is dry on business dealings. And this was a business dealing. You asked for a tow, you agreed to pay the tow, they made the tow, you gave them a bad check costing them even more money in fees... not to mention time to try and collect etc. and time is money for any business.

Likely if your ID had a valid and current address and there was no argument about the check in the first place, you might have gotten a chance to make good on it before you was charged.

It would help to know what the argument was actually about. Keep in mind you can get anything towed anyplace... just because he towed you to a particular address doesn't mean you actually lived there. Or that he should assume you did.

Tow truck drivers see people telling lies and scams all the time... likely way above average. They get assaulted by people who don't want to pay their bills, or when they recover a car for a Bank that owns it because someone didn't make their payments. Add to the fact they have probably been stiffed by more than a few other people before, and that takes money out of their pockets just like stiffing the waitress by skipping out without paying the bill. It only takes once before you assume the worst. And yes... I have a family member who actually drove a Tow truck for a period... so I know those stories are true.

You might be an honest person that made a mistake... but keep in mind they don't know you personally... to them you were someone that cost them time and money after stiffing them with a bad check. Put yourself in their shoes and think what would YOU do in their place. And few tow companies make HUGE profits. A couple cases like this may be the difference between them making their bills and payroll for the month... or not being able to.
