    My rights as a tenant in Texas if not on lease
    I am staying in an apt in Texas that was rented in my ex boyfriends name-I am not on the lease-he has left the apt and the lease has expired. The landlord has come to my apt this am and said I had to leave tonight. I did receive a eviction notice from the apt on the door on Jan. 13 stating to pay rent in full by the 18th-today-or an eviction would be filed. The landlord said I was considered a tresspasser since I am not on the lease. Can he legally kick me out without going through the courts and am I tresspassing? I need some help. I am packed up but still haven't found exactly where I am moving to. Thank you for any help you can provide.

    No, you are a resident and he has to go through a legal eviction. However, what was posted on the door was probably a three day pay or quit notice. That would leave today as the deadline. His next step is to go to court for an eviction order.

    Thank u for the response- can u send a link to a site that has something printable so I can have something as proof? I am sure the landlord is aware he can't do that to me but I would feel better. Thanks again.

    First, please use the answer this question options for follow-up, Do not start a new thread.

    It sounds to me like the landlord is doing things correctly. He gave you a 3 day pay or quit. Since you didn't quit he applies for an eviction.

    Why haven't you paid?

    The problem I guess I see, did the landlord even know you were living there. You were in fact a tenant of the person who had the lease, who moved out already,

    But if you have not paid the rent ( sounds like you are not ready to give him a check or money order)

    I bet he would love you to be there, if you were paying on time.

    But he has already posted notice for payment, so now he can go to court to evict every quickly for non payment of rent
