    Custody arrangements for non biological parents
    My sister who lives in Georgia has a 15 year old son that she is no longer able to raise. She had to send him to me and my husband who live in California. The problem is that we are military and live on base. We were informed by legal that we have to get legal custody of him. We have been working with my sister trying to get this agreement resolve. What do we need to do to get legal custody of my nephew if his mother, my sister is willing to give up the legal right. She has full legal custody of her son. We really need some guidance on this matter. Can someone please help.

    Please pay more attention to posting guidelines. There is a Read First sticky in the Children forum (where this was moved from) that directs questions of a legal nature to this forum.

    You probably only need to get legal guardianship. Check with the local Family court for how to file for legal guardianship.

    Yes, I would start with legal guardianship, but also what is the fathers status, merely having full custody does not mean father does not have some rights

    First, I would like to apologize for posting my question in the wrong forum. This is my first time ever doing something like this, but now I know. Thank you. The father is in a nursing home. My sister has legal guardianship and power of attorney on him. I will check with legal on base to find out if legal guardianship is sufficient. I assume they require legal custody because he will be traveling (doing PCS moves) and is required to get military ID and will be added to my husband's health insurance. But I will go back to legal and find out is legal guardianship is sufficint. Thank you.
