    Live-In Boyfriend in Atlanta, GA
    I recently purchased a home in atlanta, geogia. My name is solely on the deed. My boyfriend and I have been living here for 2 weeks. The only thing in his name is the power bill, trash and gas. Our relationship is not working out so I want to know what do I need to do for him to leave? Can I just change the locks and security code on the alarm system?

    No you need to give him a written eviction notice for somewhere between 7 to 30 days.
    I know the minimum in Ga is 7 but I think that is non payment of rent.
    Then if he doesn't leave by the date you go to the magistrate and file for them to serve him with another eviction order.

    You can ask him to leave but if he won't you have to do it this way.

    If he's only been living there with you for two weeks then you shouldn't have to go through any formal eviction proceedings. Your best bet is to simply ask him to leave and give him a window of time in which to do so. Inform him that after that time you'll be changing the locks and the security code on your alarm system.

    In my state if they stay overnight they are considered living there if they say that is their residence and you do have to evict them. If he was living with her prior to them moving there I think that would put some weight on his side too.

    Since his name is on utility bills he has established himself a legal resident of that house. She is going to have to go through the proper eviction process.

    Exactly J_9 my state use to say that one piece of mail or name on a utility. Then they went to saying that residency was established simply by staying over night and saying 'yes I live here'.

    To establish residency, to get a voter's registration card for example, all you have to do is show that your name is on a utility bill.

    **Edit** Staying over night and saying "yes I live here" doesn't cut it. Otherwise I'd stay at my girlfriend's half million dollar home then try to get her kicked out. Nope, doesn't work that way.

    Usually it is more than one overnight before the person with the house says leave. Then I think the police here say that because they do not want to deal with domestic problems like that so they make you go through the legal procedure if the person insists that is their residence.

    OK, in GA, he has established residency because of the bills in his name. ** you will have to change them all over to your name prior to him moving out.

    Also this means you have to give him proper notice, which is considered 30 days if there is no formal rental agreement.

    Now I will also tell you that the Atlanta City police will not do anything about this either way and merely tell the other partner to sue in civil court.
    In fact I doubt that a City police officer would even be dispatched for this. ** In the City of Atlanta if you have your car broken into, they don't even come for that, merely give you a number to file a report the next day.
    When off duty once I caught a person breaking into a home and had to wait 45 min for them to send a officer to the scene.

    But legally they have to be given notice
