    I need a way to have his parental rights terminated
    OK I have a one year old son I had his father arrested and he was put in jail twice for aggrivated 2 counts of harassment,2 counts of criminal contempt of a court order and stalking. I live in ny and he got out of jail the last time on 0ct. 15 2009 and he was awarded an hour of visitation once a week with my son. I have a restraining order on him as well.. he isn't ordered to pay any child support however in child support court he asked if there was and way he could give up his rights the judge told him no well October 15th 2009 we had court and he was released from jail he has not set up any visitation what so ever OK.. I have went through domestic violence to protect myself and my son from him and obviously nothing has helped he was awarded visitation OK I had him arrested for calling child protective services and lying saying I was sexually abusing my son it came back unfounded however but he beat me while I was pregnant and afterwards OK I need help is there anything I can do to have his parental rights taken away? If he doesn't visit my son could I get him for abandonment? If so how long do I have to wait please help me he is crazy and I can't get any kind of help or legal advice! He thinks he has full control over me and my son due to this please help!!

    For one thing what type of visitation was awarded ? Was it supervised visitation ?
    Why wasn't some kind of child support awarded even based upon minimum wage ? How did you prove that he called child protective services and how is it that you got him arrested for it ? This just isn't adding up.

    OK the child protective services thing he sent me a text message addmitting that he lied to cps then in turn was arrested because I took the message to cps and they had me forward it to a state troopers email address he was arrested for making a false statement.. the child support the reason why he isn't paying anything is because he wouldn't he asked at court if he could give up his rights in the mean time I was losing hours at work which is the only source of income I would have to support my son therefore to end the court problems there I said I didn't want child support however I can change my mind according to what the judge said.. his visitation is supervised however he has not called the supervisor to set up any visitation he keeps trying to contact me though I have a restraining order he says oneday he wants my son and the next he doesn't want him at all

    Surprised a text message was allowed in court, since they can be faked,

    But he can get and keep at least supervised visitation at a place the court appoints.

    As long as he wants to see the child you are not going to take his rights away,

    Courts are very reluctant to grant TPRs as you found out. However, one of the reasons they will grant one is when the parent is a danger to the child. But it appears he is more a danger to you, not the child.

    I would work at making the protection order permanent and trying to get visitation revoked.
