    I'm late on 1 payment and now they are suing
    I have been making payments monthly since December on some tires I had bought. No payment agreement was ever signed however I've acknowledged. With the kids starting school, finances were extremely strained in July and I was unable to make a payment on time. Within a 3-5 day span, I began to receive 5-14 calls a day at work about the payment. Even one of my co-workers whose husband works at the tire place came to me, at work, asking me for a payment. Of course by now I'm about to pull my hair out because of the way I was being treated when I couldn't make payment when they said. Today, I received a summons for the balance plus court cost. How is this fair and is this legal?

    Do an internet search for fair debt collections practices act.

    It sounds like this company is utilizing unfair debt collection techniques. One month behind hardly delegates a civil suit.

    How did you "buy" the tires without signing any type of credit application?

    Did someone lend you money for these tires?
