    If amended before the deadline of the same tax year is it considered a fraud?
    The e-file that was created on behalf of me was 1040A, since I'm a non resident alian student on F1 I need to submit 1040nr-EZ. So I did send in an amendment forms along with the cheque of $1056 which I owe to the treasury as they did refund me $1460 for my original return (my tax return should have been only $404)

    I wish to know if What happened to me by mistake will be considered as a fraud or not (because I tried to amend it as soon as I found out that I have made a mistake) and will there be a penalty?

    How long will it take for me to get an answer?

    Please be kind enough to answer this question Im really worried

    No it is not a tax fraud.

    Instead you rushed to file your original return and made a mistake. Then again you rushed to file amended tax return. You should have spent a few more days on your amended return to make sure that everything is correct.

    Thanks for answering my question. This is my first time filling tax and I wanted to fill it quickly and correct it. I feel that I filled it correctly and hoping its true. When the IRS receive my amended forms do the acknowledge accepting it or do I have to wait for about 6c months to know if they accepted it?

    The IRS cashing the check will probably be the only indication that they got and accepted the amendment at face value, unless they perceive that an error was made, in which case you will get a letter.
