    Custody issues
My boyfriend and I are having a child. Meanwhile he has two children from a previous relationship, 31/2 and 6 years old. The mother has five total. The two she has now (his) are extremely behind in school and never clean. The mother had her rights terminated on the three previous children (not his) by the state. Will they look at her past if we fight for custody? If we suspect her of drugs how easy is it for us to request continuous drug testing? She is currently unemployed, does this help? Also my boyfriend has an assault on his record as of last year, how heavy will that way on him?

Being poor is not ever the issue, not caring for the children is.
You will need an attorney, and need to dig up as much dirt as possible. In the end it will be the judges opinion

They will certainly look at why the kids were taken away and if any similar behavior is current, they will likely be less lienient.

Chuck is right though... get a good lawyer.

Who was the assault on? If it wasn't on you, the mother or a child, it likely won't affect much.

If you believe the children are in immediate jeopardy and are being neglected,I would not wait for a court to make a decision but I would contact child protective services and get them involved A.S.A.P.
