    Who is a part or full time resident in NY City?
    I'm living in New Jersey 100% at the time since y of 2007 but working in Brooklyn NY.and commuting everyday to Brooklyn. I used to live and rent an apartment in Brooklyn with my daughter and both names are on the lease.On my 2008 tax return I've claimed myself as a non-resident of NYC. The NYC Tax dept. charging me now as a part time NYC resident.Are they right?

    PS. I haven't cancel my name on the lease for pure reason of convenience.

    If you actually live in NJ, and did NOT live in the apartment at any time in 2008, then tell the NY Tax Department that.

    You should not be treated as a NYC resident if you are in fact NOT a resident.

    Now, you SHOULD get your name off that lease as soon as possible.
