    Would this be considered a second offense?
    Let's say I was taken, not arrested for underage drinking 8 months ago. They gave me a village ordinance ticket and it was turned into something in the lines of a disorderly conduct. I was given a deferred prosecution option and took it. I did everything required but was still in supervision. I was just caught taking a small price item at a store being about $11 and I got arrested. It was on accident, I offered to pay for it, but it was still considered shoplifting. Would this be considered a second offense? As it is my first time "shoplifting." And can anybody with any insight have any information on what can happen to me?

    I'm 17 and in the state of Illinois, Cook County.

    I'm really afraid. I'm a good kid who happens to make mistakes and bad decisions. I've been trying to reverse my ways and I happened to get in this mess. I don't want to go to juvie and leave my parents.

    Hello sorry:

    Of course you're afraid. You got caught. TRYING to reverse your ways ISN'T reversing your ways - it's TALKING about reversing your ways.

    When you're "taken", you've been arrested. The "arrest" is the beginning of the legal process. It doesn't mean they threw you on the ground and read you your rights.

    You said you WERE under supervision. I guess that means you AREN'T now. That's good, because your supervision would be violated.

    Will your previous run in with the law be taken into consideration this time?? Yup.

    I was not arrested as I wasn't put in cuffs nor taken to the station. That's what I was told.

    I still need an answer for my main question.

    Would this be a second offense?

    Sorry but it is a second offense, a ticket is still an offense, you don't have to be handcuffed, you actually sign the ticket instead of being arrested.

    And since you were still on supervision for the first, you have to report it to them, which will change the terms of that agreement.

    So your attorney may get you out of these, since they are all minor offenses, it is a second offense.
