Ok what if you do not know the biological fathers whole first name and last name. And have not seen him since the day you had sex. So he does not know about the baby and you have know way of finding him. Now what do I do if the one I am getting married to wants to be her father. :o

It depends on the state. An adoption attorney can assist.

In Arkansas, the Arkansas Dept of Human Services has an Affidavit of paternity that a presumptive father can fill out to add his name to a child's birth certificate. If a man accepts a child as his legal child, this would be the most quick and cheapest method. Check with your state's dept of vital statistics (where obtain a copy of birth certificate) on the procedure there.

Get a lawyer.

Adoption law is strict, for good reasons, and not following it can come back to bite you in the rear if you're not careful.

You must make an HONEST attempt to contact the biological father. Regardless how uninformed YOU were when you had sex with him, he still has rights to his child, whether he is USING those rights.

Let's put it this way: If you make it easy to take away someone's rights just because you don't know their full name and were dumb enough to have sex with someone whose full name you didn't know, then you make it easy for someone ELSE to come in and take away YOUR parental rights. It SHOULDN'T be easy for adoption to happen, and it SHOULDN'T be easy to terminate someone's parental rights--can you imagine what would happen if, say, a parent could terminate their 15 year old daughter's rights to her child so that THEY could place it for adoption? That's essentially what you're saying when you want to terminate the biological father's rights without giving him a chance to refute it--even if he doesn't even KNOW about the baby (sounds like a failing on YOUR part there--you should have at LEAST been collecting child support).

So---my advice, AGAIN, is to get a lawyer. Pay the money that it will take to make this happen, and don't look for an easy out on things.
