    Rights of a heir
    I am listed as a heir in my aunts estate. I have asked the lawyer who is handling the estate to send me an accounting of the money. He has not returned my calls. What right do I have? He promised me one year ago the money was ready to be dispersed.

    Write the attorney a letter, perhaps by certified mail where he must sign acknowledging receipt of your letter, keep a copy, in the letter, provide him some proof if you have it, that you are an heir (proof such as a copy of her will or other proof) and that you have rreason to believe there are assets to which you are entitled, request that he respond in no more than 10 days, otherwise you will appear before the Probate Court (or other court with jurisdiction over the matter) to show cause why he should not provide you with an accounting. By the way, if the matter is public meaning that if there a will that had to filed and probated in court, then you may want to bypass the above and go to the Court and obtain a copy of the final accounting of the estate. If all fails, you could hire your own attorney or contact the bar association but before you contact the bar association, give the attorney a fair chance to answer your written requests.
