    Letter to community about what we owe. Legal?
    :mad: :mad: We bought a couple of rental properties at a lake resort. I did not realize that there were mandatory home owner dues for each condo.

    We have moved a couple of times and apparently they could not get a letter to us.

    Recently we did finally receive a letter from the home owner's association that was sent to every person in the community that states that we were very irritating because we never pay our dues. It stated our names and the exact amount that we owed.

    Is this legal? Can they legally put out a community letter that states how much we owe?

    I really appreciate every one's attention!

    I am going to say I don't know but tell you why

    In general a business can not discuss what you owe with anyone else, to do so is a violation and they would be liable for this.

    BUT>>> since this is a home owners association and since each member or home owner is part owner of the association, the money matters of the group is not private from the various owners. So your debt and how to collect could have been brought up in meetings and discussed by the owners ( home owners) of the HOA.

    I sit on a Lake Resort home owners board, hope we did not do this, but you should get a copy of their covenants and the by-laws. You are probably going to find that you have agreed to a lot more than you knew. Like Fr_Chuck says there is little privacy within a HOA since everyone is a member. It was not a nice thing to do but it is legal. If you break a rule and get a fine that too will be published in the newsletter. They can not state anything that is not factual, but they can print you name and the amount. I am surprised this info was not handed to you at or soon after closing. Bet they have some special rules about rentals too.
