Are we talking child or spousal support? Child support is generally specified by law based on income. Spousal support is generally a negotiation as part of the divorce. In either case, if the person cannot pay what the court ordered, he has to go back to court for a modification. Until that time he continues to owe what the court ordered and that amount builds up.

This is the Family Law forum. Responses here need to follow statutory law. Not something you "believe". Spousal support is considered in a variety of situations depending on family finances, status and local law. It is more likely to be considered under the circumstances you mentioned, but there is no hard and fast rule. More often than not its negotiated as part of the divorce settlement. Child support is not "always" mandatory, but is more common than spousal support.

I apologize. I mentioned believe based on the fact I do not know where they are located. Some states by law consider spousal support within mediation/court if the spouse did not work outside the home. I will watch how I word things more precisely. Thank you for your input.

Your quoted site is from Georgia law. Georgia as in the US or Georgia as in Russia? Laws in Georgia don't apply to the world. Since we don't know where in the world the OP comes from, your link is inappropriate, as is your reddie to me.

Irregardless, there are still situations where child support would not be ordered.

*Edit to add... What if the is the father asking advice and not the mother? Would your advice change?
