    Renter problem
    Just getting ready to sign papers on my mothers house that is in a trust. She passed away last jan. The problem is her step grandson is living there and doesn't want to move. The person that bought the house needs immediate possession and it is a cash sale. Are we going to lose this sale just because he won't move. He wants at least 30 days... but that will cost us the sale. We only have verbal agreements with him and he only pays the amount for taxes and water which is 200 dollars a .month.. Please help as this whole estate -trust thing has been going on for almost a year.

    Depending on where you live, you need to give the step-grandson the required written notice before you can sue to evict him. Looks like he has a month-to-month tenancy, which would normally require at least 30 days.

    Do you have an attorney helping you with the trust? I think you need one.

    I agree with AK, the step son has established residency and you need to deal with him as any tenant. He has to be given legal notice to vacate.

    You should have considered this as soon as the house was listed for sale. So, he is within his rights to ask for 30 days written notice. Can another relative put him up until he can find a new place? Rather than lose the sale, it might be cheaper to put him up in a motel and put his things in storage for a month. If he will agree to it.
