    Custody rights
    My husband and I are wanting to know how to get custody of my almost 17 year old brother who is mentally challenged who is living with my parents in another state. He was adopted by my parents and placed in our home at the age of 16 months but adopted at 4 years old by them. My mother has admitted to me they do not know if they can continue to care for him the way he needs. My mother has medical conditions and so does my father and he does work very long hours between noon and 5 am every day. My mother has also told me numerous times they can not find a school that will work with him or Dr's that will work with him cause they do not deal with his type of needs. My brother has told me numerous times he wants to move back to this state to be with me and my husband and according to my mother after they moved to another state my brother screamed sissy in his sleep for almost 6 months. We need to know what to do to get things going and if someone could help point us in the right direction it would be so great. I know us doing this will upset the family but we are only looking out for the concern of what he needs that he is not getting there.

    What states? When will he be 18? Will he be required to have a guardian or someone by law due to his condition?

    We live in Kansas my parents and brother are in Georgia.he will be 18 in about a year and 2 months. Yes due to his conditions he will need someone with him. He does not understand things very well and has a lot wrong with him. He has autism, fetal alcohol, and numerous other conditions, he can not speak very well and has to be reminded of things a lot.

    Also I have pretty much raised him when my parents could not due to medical problems or lack of work. Mother has addiction to narcotics and has an amputated leg along with mrsa. Father has had a broken neck in past.

    You should contact an attorney in Georgia to begin the process now.

    The best course is to retain an attorney to file the paperwork. The next best thing is to contact the local Family Services agency where he lives. If he needs the attention you say, it is likely that he is known to them and he has a case worker. So contact that person.
