How does a grandparent get custody of grandson in Iowa
Hello my name is Colton,
My dad recently passed away from cancer. Him and his lady friend had a baby together. He is now 7 years old and is my half bother. His mother is a horrible mom, recently had one of her kids taken away from kids dad for being unfit. She has been arrested for drugs. She always has different guys over and unclean housing conditions. My dad has raised Jackson this whole time, on the written agreement that she not pay child support if he can raise jackson. Now that he has passed away she wants jackson. Can my grandmother get emergency custody of my half brother. |

She would have to prove the mother unfit. However, if she has a record of drug use and has already had a child taken away this may not be hard to prove. So grandma needs to go to court and file a petition for emergency custody. I would advise that she consult an attorney.
