My child's father sees her maybe 1 our or so every month or month and a half. I have custody (not court ordered, just implied). I wish to take him to court to have his parental rights terminated. He is an alcoholic, numerous public intox violations. He also got a serious assault charge just last year and an OWI a few months ago and is now looking at 6 months in jail. He does nothing to support her and hasn't paid for anything since she was born. I want his rights terminated because I want to fill out a will naming my parents as her guardians if I were to die, but it won't do any good if he hasn't had his rights terminated because he could just take her from them. Also, he IS on the birth certificate. What can I do to get his rights terminated or is that even possible.

You need to file for child support and have the judge grant you custody. And no, you just can't have his rights terminated. Why not get the child support from him as this is his child after all?

If you decide to get married and your new husband wants to adopt your child, it is at that point that the biological father's rights can be terminated if he agrees to the adoption. There is no other way to have his rights terminated.
